Procedures For Issuance Of Visa For Foreigner’s Family

I. General provisions

According to Vietnamese law, foreigners who are relatives of Vietnamese people or foreigners legally residing in Vietnam will be granted a relative visit visa.

Accordingly, the State of Vietnam creates conditions for relatives who are relatives to enter Vietnam to meet individual needs.

Ii. Conditions for foreign relatives to be granted a relative visit visa

In order for a relative of a foreigner to be granted a visa to enter Vietnam, that person must satisfy the following conditions:

–  Spouses, children under 18 years old of foreigners who have been granted visas in Vietnam;

–  Spouses, children under 18 years of age of foreigners who have been granted temporary residence cards in Vietnam;

–  Spouses, children under 18 years of age of foreigners who have been granted temporary residence cards in Vietnam;

–  Foreigners are fathers, mothers, spouses, and children of Vietnamese citizens;

In addition, foreigners sponsoring their relatives to enter Vietnam must be granted visas, temporary residence cards with symbols of the conditions to guarantee the conditions of law, including:

LS – Issued to foreign lawyers practicing in Vietnam.

DT1 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam and contributing capital of VND 100 billion or more or investing in business lines benefitting from investment incentives, in administrative divisions benefitting from investment incentives decided by the Government.

DT2 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam and contributing capital of VND 50 billion to less than VND 100 billion or investing in business lines benefitting from investment incentives treatment decided by the Government.

DT3 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam and contributing capital of VND 3 billion to less than VND 50 billion

NN1 – Issued to Managers of representative offices or projects of international organizations and foreign non-governmental organizations in Vietnam.

NN2 – Issued to heads of representative offices, branches of foreign traders, representative offices of other foreign economic, cultural, professional organizations in Vietnam

LD1 – Issued to foreigners working in Vietnam and certified of eligibility for work permit exemption, unless otherwise specified by international agreements to which Vietnam is a signatory.

LD2 – Issued to foreigners working in Vietnam requiring work permit.

DH – Issued to people who come to study or serve internship.

Iii. Visas are issued to foreign relatives and validity period

The foreigners who are eligible for a visa to enter Vietnam will have the visa symbol TT.

The duration of a foreigner’s visiting visa does not exceed 12 months.

Iv. Application file for visas for relatives who are foreigners

A Vietnamese or a foreigner applying for a visa will submit a set of documents to the immigration authority, including the following documents:

Petition for relatives who are foreigners to enter;

Guaranteed foreigner’s passport;

Passport / Identity card of the sponsor;

Visa / Temporary residence card of the sponsor;

Documents proving the relative relationship with the foreigner;

Other documents.

v. Order and procedure

Within 5 working days from the date of receipt of a complete and valid dossier, the competent agency shall consider, settle and reply to foreigners inviting or sponsoring individuals and organizations. In case the application is valid, the competent authority shall issue a written approval of the foreigner’s entry and notify the diplomatic mission / international border gate to issue the visa.
