Procedure For Issuance Of Temporary Card For Foreign Workers In Vietnam

According to Vietnamese Law, the foreign worker who has been issued a Work Permit/ Work Permit Exemption by the Department of Labor, War Invalids and Social Affairs, can have a temporary residence card in Vietnam.

Temporary residence cards issued to foreign workers will be based on visas, work permit validity and passport validity.

Temporary residence card for foreign workers includes:

–   Temporary residence card has been issued to the employee who have Work Permit;

–   Temporary residence card has been issued to the employee who have Work Permit Exemption.

Foreigners worker must also satisfy the conditions and follow the procedures prescribed by Vietnamese law to be granted a temporary residence card.

–   The foreign worker must have a visa symbol suitable for the purpose of considering the grant of a temporary residence card in Vietnam, including:

LD1 – Issued to foreigners working in Vietnam and certified of eligibility for Work Permit Exemption, unless otherwise specified by international agreements to which Vietnam is a signatory.

LD2 – Issued to foreigners working in Vietnam requiring Work Permit.

DN1 – Issued to foreigners working with other enterprises and organizations that are juridical person as per the law of Vietnam.

–   The employees must be granted one of the following permits by a competent agency in Vietnam:

Work Permit;

Work Permit Exemption.

–   Foreign workers must register for temporary residence in the locality in accordance with the Vietnamese law;

–   Passport is valid at the time of application for temporary residence card.

From 01 July 2020, the Law amending and supplementing the Law on entry, exit, transit, and residence of foreigners in Vietnam comes into effect, validity of temporary residence cards issued to foreign workers will be valid for up to 2 years and depends on the duration of the Work Permit / Work Permit Exemption.

An application for a temporary residence card for a foreigner includes:

+  An application for temporary residence card;

+  Application form for temporary residence card for foreigners;

+  A document introducing the seal and signature of the authorized person of the organization;

+  Temporary residence certification issued by local police;

+  Original passport with visa with corresponding symbol;

+  Work Permit/ Work Permit Exemption;

+  3x4cm photo, white background;

The individual or organization applying for a temporary residence card for a foreigner must submit the application to the Immigration Department.

Within 5 working days from the date of receipt of a valid application, the Immigration Department will consider for issuing a temporary residence card to a foreigner.
