Frequently Asked Questions

The provision of a 13th-month salary in Vietnam is not mandatory; it is contingent on the company’s annual performance. Investors have the flexibility to decide whether to adopt this bonus structure in Vietnam or not.

In addition to the 13th-month pay, employees in Vietnam are entitled to various mandatory benefits, including:

  • Annual Paid Holidays: Employees enjoy fully paid annual leave of 12 days, along with 10 public holidays, which increased to 11 days from January 1, 2021. They can also take fully paid leave for personal reasons, such as marriage (3 days), marriage of their child (1 day), or in case of the death of a blood parent, parent of their spouse, spouse, or child (3 days).
  • Rest Breaks during Working Hours: Employees working eight consecutive hours or six hours are entitled to a break of at least 30 minutes, which is included in the working hours. Night workers are entitled to a break of at least 45 minutes during their working schedule, also counted in the working hours.
  • Weekly Breaks: Every week, employees are entitled to a break of at least 24 consecutive hours. In special cases, employers must ensure that employees have at least four days off on average in a month.
  • Insurance Regime: Employees benefit from compulsory social insurance, compulsory health insurance, and unemployment insurance, in accordance with the social insurance and health insurance laws.
  • Annual Health Check: Employees are entitled to annual health check-ups, conducted once per year.

In Vietnam, maternity leave for female employees spans six months—three months before and three months after childbirth. In the case of a female employee giving birth to twins or more, an extra month of leave is granted for each additional infant from the second.

It’s important to note that the maternity leave period before childbirth should not exceed two months.

Male employees, who are currently contributing to social insurance premiums, are entitled to maternity leave under the following conditions:

  • 5 working days if their wives give birth.
  • 7 working days if their wives undergo a surgical birth or give birth before 32 weeks of pregnancy.
  • 10 working days if their wives give birth to twins, with an additional three working days for each infant from the second.
  • 14 working days if their wives give birth to twins or more infants and undergo a childbirth operation.

This maternity leave must be taken within the first 30 days after the date of childbirth.

While there is no specific salary tax, personal income tax, social insurance, and other taxes exist. Typically, the company covers these expenses on behalf of the employee.

However, if the employee earns income from sources other than their salary, they are required to finalize the tax directly with the tax authorities.

The company cannot automatically handle this process on behalf of the employee, as it is unrelated to taxes associated with additional sources of revenue.

In Vietnam, the calculation of social insurance involves a contribution from both the employer and the employee. The employer covers 17.5% of the gross salary, and the employee is responsible for a contribution of 8%. 

The amount of employee income tax in Vietnam depends on the individual’s tax residency status. For tax residents, employment income is subject to progressive rates ranging from 5% to 35%, based on monthly taxable income. Non-tax residents are subject to a fixed PIT rate of 20%.
